1. PURPOSE OF THE PLATFORM

Kyndlo is an intelligent friendship-matching platform designed to help users build genuine, platonic relationships through shared interests, hobbies, and social activities.

The Platform is strictly intended for:

• Friendship
• Community connection
• Social wellness

The Platform is not for dating, romantic relationships, sexual interaction, political discourse, or religious discussion.

Any use outside this purpose is prohibited.

2. ELIGIBILITY & AGE REQUIREMENTS

Users must be at least 18 years old to use the Platform.

By creating an account, you represent and warrant that you meet this age requirement.

We do not verify age and are not liable for misrepresentations. We reserve the right to verify age and suspend or terminate accounts providing false information.

3. USER ACCOUNTS

Users agree to:

• Provide accurate information
• Maintain account security
• Use the Platform only for its intended purpose

You are responsible for all activity under your account. Kyndlo is not liable for unauthorized access or activity.

4. INFORMATION WE COLLECT

We do not use your data for dating, political profiling, or religious profiling. We provide no guarantees regarding matches, activity recommendations, or outcomes. Use of the Platform is at your own risk.

If required by law or to protect safety and rights. We are not liable for any disclosure made in good faith.

However, no system is 100% secure. Kyndlo is not liable for data breaches, unauthorized access, or information loss beyond our control.

9. THIRD-PARTY LINKS & INTEGRATIONS

• (a) The privacy practices, content, or accuracy of third-party services;
• (b) Any purchases, transactions, or interactions with third parties;
• (c) Any damages arising from third-party links or integrations.

Your use of third-party services is subject to their own terms and privacy policies.

10. COMMUNITY STANDARDS & PROHIBITED CONDUCT

To protect safety and inclusivity, users may not engage in:

• Romantic or sexual content or advances
• Flirting or dating solicitation
• Political or religious advocacy or debate
• Harassment, bullying, threats, or hate speech
• Discrimination of any kind
• Explicit or violent content
• Spam, scams, impersonation, or fraud

We reserve the right to remove content or accounts violating these rules. Violations may result in content removal, account suspension, or permanent termination without prior notice. Kyndlo reserves the right to report violations to law enforcement if we suspect illegal activity.

11. MODERATION & ENFORCEMENT

We use a graduated response system:

• Step 1 – Warning: Educational notice of policy violation
• Step 2 – Temporary Suspension: Restricted access for continued or serious violations
• Step 3 – Permanent Removal: For repeated or harmful behavior

Immediate Termination may occur for:

• Harassment or threats
• Sexual misconduct
• Hate speech
• Scams or safety risks

Enforcement decisions are final.

12. OFFLINE MEETUPS & ASSUMPTION OF RISK

The Platform may suggest or facilitate connections that result in in-person meetings. Unless explicitly stated, Kyndlo does not supervise or control offline interactions.

By participating in any in-person meetup or activity, you acknowledge:

• Participation is voluntary
• You assume all risks associated with meeting others
• You are responsible for your own safety and behavior

13. SAFETY GUIDANCE DISCLAIMER

Any safety tips provided are for informational purposes only and do not create a duty of supervision or liability.

14. CONSENT FOR GROUP ACTIVITIES

By joining Platform-featured group activities, users acknowledge:

• Participation is voluntary
• They assume all risks
• They agree to follow community standards
• They release Kyndlo from liability

Additional consent may be required for certain events.

15. CONTENT OWNERSHIP

Users retain ownership of content they post.

By posting content, you grant Kyndlo a non-exclusive, royalty-free, worldwide license to use, display, and distribute content for platform functionality, moderation, and promotion.

Private messages are not sold.

16. PRIVACY

Use of the Platform is governed by our Privacy Policy, which explains:

• What data we collect
• How it is used
• How it is protected

By using the Platform, you consent to these practices.

17. TERMINATION

We may suspend or terminate access for:

• Policy violations
• Safety risks
• Misuse of the Platform

Kyndlo may terminate, suspend, or restrict access at any time, for any reason, without prior notice. Users may delete their account at any time.

We do not warrant that the Platform will meet your expectations or that defects will be corrected.

Users agree to indemnify and hold harmless Kyndlo, its affiliates, officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Their use of the Platform
• Their interactions with other users
• Their participation in offline activities
• Violations of these Terms

21. MEDICAL & WELLNESS DISCLAIMER

Kyndlo is a social matching platform and does not provide medical, psychological, or professional health advice. The Platform is not a substitute for professional care. Users assume all risks related to in-person activities or wellness-related interactions.

22. ARBITRATION & DISPUTE RESOLUTION

Any dispute arising from these Terms or your use of the Platform shall be resolved:

• (a) First, through good-faith negotiation between the parties for 30 days;
• (b) If unresolved, binding arbitration under the rules of the American Arbitration Association (AAA);
• (c) Arbitration shall take place in Broomfield, Colorado, and use English language;
• (d) Class action waiver: You may not participate in or bring class action claims against Kyndlo; all disputes shall be handled individually.

Note: The Broomfield County, Colorado venue shall only apply to claims that are legally permitted to be brought in court (such as seeking emergency injunctive relief). All other disputes shall be resolved through arbitration as described above.

23. FORCE MAJEURE

Kyndlo is not liable for failures or delays caused by events beyond our reasonable control, including:

• Natural disasters, war, terrorism, or civil unrest
• Government actions, laws, or regulations
• Internet outages, server failures, or third-party service disruptions
• Pandemics or public health emergencies

24. INTELLECTUAL PROPERTY

All content, trademarks, logos, and materials on the Platform are owned by Kyndlo or its licensors. Unauthorized use is prohibited. You may not copy, reproduce, or distribute Platform content without written consent.

25. GOVERNING LAW

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles. Any claims that are legally permitted to be brought in court shall be filed in Broomfield County, Colorado.

26. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them enforceable.

27. CHANGES TO TERMS

We may update these Terms at any time. Continued use constitutes acceptance of revised Terms. We will notify users of material changes via the Platform or email.

28. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Kyndlo regarding Platform use, superseding all prior agreements, representations, or understandings.

29. SURVIVAL

Sections 18 (Disclaimer), 19 (Limitation of Liability), 20 (Indemnification), 22 (Arbitration), 25 (Governing Law), and 26 (Severability) shall survive termination of these Terms.

California Residents

This section applies to residents of California pursuant to the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

Your Rights Under California Law:

• Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we collect, use, and disclose.
• Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
• Right to Opt-Out: You have the right to opt-out of the sale of your personal information (we do not sell personal information).
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
• Right to Correct: You have the right to request correction of inaccurate personal information.

Colorado Residents

This section applies to residents of Colorado pursuant to Colorado Revised Statutes and regulations.

Consumer Protection:

Kyndlo complies with the Colorado Consumer Protection Act (CCPA). As a friendship-matching platform, we are committed to fair dealing and transparency in all interactions with Colorado residents.

Age Verification:

We do not independently verify user age. By using the Platform, Colorado residents represent and warrant they are at least 18 years of age. We are not liable for misrepresentations.

Data Security:

We implement reasonable safeguards to protect personal information of Colorado residents, including encryption of sensitive data, access controls, regular security assessments, and employee training on data protection.

Wellness Activity Disclaimer:

Kyndlo is not a healthcare provider. Any wellness-related activities or recommendations (including yoga, meditation, or fitness events) do not constitute medical advice. Colorado residents assume all risks related to in-person wellness activities.

Interstate & International Users

If you access the Platform from outside Colorado or California: These state-specific disclosures are provided as a courtesy and may not reflect all applicable laws in your jurisdiction. Your use of the Platform is governed by Colorado law as stated in Section 25. You are responsible for complying with the laws of your jurisdiction.
